Dangerous ANC member released from prison due to Ramaphosa’s “special pardon”

Andile Lungisa, former ANC councilor of the Nelson Mandela Bay, application for leave to appeal against his two-year imprisonment sentence failed.

Nine judges of the constitutional court, including Chief Justice Mogoeng Mogoeng, have ruled that the case does not fall under the constitutional court’s jurisdiction, and the appeal has no reasonable prospect of success in any case.

Lungisa was released on parole on Tuesday from North End Prison in Port Elizabeth after serving just about three months of his sentence.

According to the Department of Correctional Services (DCS), this parole was due to the special pardon of sentences handed down by President Cyril Ramaphosa on 16 December 2019, shortening Lungisa’s sentence by 12 months.

The Port Elizabeth Magistrate’s Court found Lungisa guilty in 2018 on a charge of assault with intent to cause grievous bodily harm.
